Welcome to PingHawk. These Terms of Use (“Terms”) govern your access to and use of the website https://www.pinghawk.net and the PingHawk uptime monitoring platform (collectively, the “Service”), operated by PingHawk (“we,” “us,” or “our”).
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Accounts
To use certain features of the Service, you must create an account. You agree to:
- Provide accurate, current, and complete information during registration
- Maintain the security of your password and account
- Promptly update any information that changes
- Accept responsibility for all activities that occur under your account
We reserve the right to suspend or terminate accounts that violate these Terms.
2. Use of the Service
PingHawk provides uptime monitoring services, including website and service health checks, incident detection, alert notifications, and analytics dashboards.
You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:
- Use the Service to monitor websites or services you do not own or have authorization to monitor
- Attempt to gain unauthorized access to any part of the Service
- Interfere with or disrupt the Service or its infrastructure
- Use the Service to transmit malicious code or conduct denial-of-service attacks
- Resell or redistribute the Service without our written consent
- Use the Service in any manner that could damage, disable, or impair the Service
3. SMS/Text Messaging Terms
PingHawk offers SMS text message alert notifications as part of its uptime monitoring service. By opting in to receive SMS alerts, you agree to the following terms:
3.1 Service Description
The PingHawk SMS Alert Program sends automated text message notifications related to the uptime status of your monitored websites and services. Messages include downtime alerts, recovery notifications, periodic reminder alerts, and SSL certificate expiry warnings.
3.2 Opt-In and Consent
You opt in to receive SMS alerts by voluntarily adding your mobile phone number as an SMS alert recipient during the alert configuration process within the PingHawk web application. You must be logged into your authenticated PingHawk account to configure SMS alerts. By adding your phone number, you expressly consent to receive automated SMS alert messages from PingHawk at the number provided.
3.3 Message Frequency
Message frequency varies and depends on the number of monitors you have configured with SMS alerts and the frequency of incidents affecting your monitored services. You have full control over which monitors send SMS alerts through the PingHawk dashboard.
3.4 Message and Data Rates
Message and data rates may apply. Please consult your wireless carrier for details regarding your text messaging plan and any applicable charges.
3.5 Opt-Out
You can opt out of receiving SMS messages at any time by:
- Replying STOP (or CANCEL, END, QUIT, UNSUBSCRIBE, REVOKE, OPTOUT, or STOPALL) to any SMS message received from PingHawk
- Removing your phone number from alert recipients through the PingHawk dashboard
After sending STOP, you will receive a one-time confirmation message. No further SMS messages will be sent unless you re-subscribe.
3.6 Help

3.7 Privacy
Your mobile phone number and SMS opt-in data will not be shared with, sold to, or disclosed to any third parties or affiliates for marketing or promotional purposes. For full details, please review our Privacy Policy (https://www.pinghawk.net/privacy/).
3.8 Carrier Liability
Carriers are not liable for delayed or undelivered messages. Message delivery is subject to effective transmission from your network and is not guaranteed.
4. Subscription and Payment
Some features of the Service require a paid subscription. By subscribing to a paid plan:
- You agree to pay all applicable fees as described at the time of purchase
- Fees are billed in advance on a recurring basis (monthly or annually)
- You authorize us to charge your selected payment method
- All fees are non-refundable except as required by law or as stated in our refund policy
We reserve the right to change pricing with 30 days’ notice.
5. Intellectual Property
The Service and its original content, features, and functionality are owned by PingHawk and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without our prior written consent.
6. User Data
You retain ownership of all data you provide to the Service, including monitor configurations and associated content. We claim no ownership over your data. By using the Service, you grant us a limited license to use your data solely to provide and improve the Service.
7. Third-Party Services
The Service may integrate with or contain links to third-party services. We do not control and are not responsible for the content, privacy policies, or practices of third-party services. Your use of third-party services is at your own risk.
8. Disclaimer of Warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that:
- The Service will be uninterrupted, timely, secure, or error-free
- The results obtained from the Service will be accurate or reliable
- Any defects in the Service will be corrected
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PINGHAWK AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.
Our total liability for any claims arising from your use of the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.
10. Indemnification
You agree to indemnify, defend, and hold harmless PingHawk and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorney’s fees) arising out of or related to:
- Your use of the Service
- Your violation of these Terms
- Your violation of any rights of a third party
11. Termination
We may terminate or suspend your access to the Service at any time, with or without cause, with or without notice. Upon termination, your right to use the Service ceases immediately.
You may terminate your account at any time by contacting us or using the account settings in the dashboard.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of New York, United States, without regard to its conflict of law provisions.
13. Changes to These Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the “Last Updated” date. Your continued use of the Service after changes constitutes acceptance of the updated Terms.
14. Electronic Communications
By creating an account, you consent to receive electronic communications from us (e.g., email, SMS, in-app notifications). You agree that all agreements, notices, and other communications provided electronically satisfy any legal requirement that such communications be in writing.
